  17.     At  12:01 ON the  morning of November 4,  1952, a new federal
  18. agency was born.  Unlike other such bureaucratic births, however,
  19. this one arrived in silence.   No news coverage, no congressional
  20. debate, no press announcement,  not even the whisper of  a rumor.
  21. Nor could any  mention of  the new organization  be found in  the
  22. Government Organization  Manual of  the Federal  Register or  the
  23. Congressional Record.   Equally invisible  were the new  agency's
  24. director, its numerous buildings, and its ten thousand employees.

  26.     Eleven days earlier,  on October 24, President Harry S Truman
  27. scratched  his   signature  on   the  bottom   of  a   seven-page
  28. presidential memorandum addressed  to secretary of State  Dean G.
  29. Acheson  and Secretary of  Defense Robert A.  Lovett.  Classified
  30. top  secret  and  stamped  with  a  code  word  that  was  itself
  31. classified, the  order directed the establishment of an agency to
  32. be  known as  the National  Security Agency.    It was  the birth
  33. certificate  for  America's  newest and  most  secret  agency, so
  34. secret in  fact that only  a handful  in the government  would be
  35. permitted to know of its existence.

  47. MEMORANDUM FOR:     The Secretary of State
  48.                     The Secretary of Defense
  49.  
  50. SUBJECT:  Communications Intelligence Activities
  51.  
  52.     The  communications intelligence  (COMINT) activities  of the
  53. United States are  a national  responsibility.  They  must be  so
  54. organized and managed as to exploit  to the maximum the available
  55. resources in all  participating departments  and agencies and  to
  56. satisfy  the legitimate  intelligence  requirements  of all  such
  57. departments and agencies.
  58.  
  59.     I  therefore designate  the Secretaries of  State and Defense
  60. as  a Special  Committee  of the  National  Security Council  for
  61. COMINT,  which  Committee  shall,  with  the  assistance  of  the
  62. Director of  Central Intelligence,  establish policies  governing
  63. COMINT  activities. and keep me advised  of such policies through
  64. the Executive Secretary of the National Security Council.
  65.  
  66.     I  further designate  the Department of  Defense as executive
  67. agent  of   the  Government,   for  the   production  of   COMINT
  68. information.
  69.  
  70.     I  direct  this  Special  Committee  to  prepare   and  issue
  71. directives which shall include the provisions set forth below and
  72. such other provisions  as the Special Committee  may determine to
  73. be necessary.
  74.  
  75.     1.    A   directive  to   the  United   States  Communication
  76. Intelligence  Board  (USCIB).  This  directive will  replace the
  77. National Security Council Intelligence Directive No. 9, and shall
  78. prescribe   USCIB's   new   composition,   responsibilities   and
  79. procedures in the  COMINT fields.   This directive shall  include
  80. the following provisions.
  81.  
  82. a. USCIB  shall be reconstituted  as a body  acting for
  83.     and  under  the  Special  Committee,  and  shall  operate  in
  84.     accordance with the  provisions of  the new directive.   Only
  85.     those  departments  or  agencies  represented  in  USCIB  are
  86.     authorized to engage in COMINT activities.
  87.  
  88. b.  The  Board  shall  be  composed  of  the  following
  89.     members:
  90.      (1) The  Director  of  Central Intelligence,  who shall be
  91.          the Chairman of the Board.
  92.      (2) A representative of the Secretary of State.
  93.      (3) A representative of the Secretary of Defense
  94.      (4) A representative of the Director of the Federal
  95.          Bureau of Investigation.
  96.      (5) The Director of the National Security Agency.
  97.      (6) A representative of the Department of the Army.
  98.      (7) A representative of the Department of the Navy.
  99.      (8) A representative of the Department of the Air Force.
  100.      (9) A representative of the Central Intelligence Agency.
  101.  
  102. c. The Board shall have a  staff headed by an executive
  103.     secretary who  shall be  appointed by the  Chairman with  the
  104.     approval of the majority of the Board.
  105.  
  106. d. It shall be the duty of the Board to advise and make
  107.     recommendations to the  Secretary of  Defense, in  accordance
  108.     with  the  following procedure,  with respect  to  any matter
  109.     relating  to communications  intelligence which  falls within
  110.     the jurisdiction of the Director of the NSA.
  111.      (1) The Board shall reach its decision by majority
  112.      vote.  Each  member of  the Board shall  have one  vote
  113.      except the  representatives of  the Secretary  of State
  114.      and of the  Central Intelligence Agency who  shall each
  115.      have two votes.  The  Director of Central Intelligence,
  116.      as Chairman, will have no vote.  In the event  that the
  117.      Board  votes  and reaches  a  decision,  any dissenting
  118.      member  of  the  Board may  appeal  from  such decision
  119.      within 7 days of  the Special Committee.  In  the event
  120.      that the Board votes but fails to reach a decision, any
  121.      member of the  Board may  appeal within 7  days to  the
  122.      Special  Committee.    In   either  event  the  Special
  123.      Committee   shall   review    the   matter,   and   its
  124.      determination thereon shall  be final.  Appeals  by the
  125.      Director  of NSA  and/or  the  representatives  of  the
  126.      Military  Departments  shall  only  be  filed with  the
  127.      approval of the Secretary of Defense.
  128.      (2) If any matter is voted on by the Board but -
  129.       (a)  no decision  is reached  and any  member
  130.       files an appeal;
  131.       (b)  a  decision  is  reached  in  which  the
  132.       representative  of the  Secretary of  Defense does
  133.       not concur and files an appeal;
  134.      no action  shall be taken  with respect to  the subject
  135.      matter until the  appeal is decided, provided  that, if
  136.      the Secretary of Defense determines, after consultation
  137.      with the Secretary  of State,  that the subject  matter
  138.      presents a problem of an  emergency nature and requires
  139.      immediate action,  his decision  shall govern,  pending
  140.      the  result  of  the  appeal.   In  such  an  emergency
  141.      situation  the  appeal  may be  taken  directly  to the
  142.      President.
  143.      (3)  Recommendations  of  the  Board  adopted   in
  144.      accordance  with  the  foregoing  procedures  shall  be
  145.      binding on the Secretary of Defense.   Except on matter
  146.      which have been voted on by  the Board, the Director of
  147.      NSA shall discharge  his responsibilities in accordance
  148.      with his own  judgment, subject to the direction of the
  149.      Secretary of Defense.
  150.      (4) The Director  of NSA  shall make such  reports
  151.      and furnish  such information from time to  time to the
  152.      Board,  either orally  or in  writing, as the  Board my
  153.      request, and shall bring to  the attention of the Board
  154.      either in such reports or  otherwise any major policies
  155.      or programs in advance of their adoption by him.
  156. e. It  shall  also be  the duty  of  the Board  as to
  157.     matters not falling within the jurisdiction of NSA;
  158.     (1) To coordinate the  communications intelligence
  159.     activities   among   all   departments   and   agencies
  160.     authorized by the President to participate therein;
  161.     (2) To initiate, to formulate policies concerning,
  162.     and  subject  to  the  provision of  NSCID  No.  5,  to
  163.     supervise all arrangements with  foreign governments in
  164.     the field of communications intelligence; and
  165.     (3)   to   consider   and   make   recommendations
  166.     concerning   policies   relating    to   communications
  167.     intelligence of common interest  to the departments and
  168.     agencies, including security  standards and  practices,
  169.     and, for  this purpose,  to investigate  and study  the
  170.     standards  and   practices  of  such   departments  and
  171.     agencies   in   utilizing    and   protecting    COMINT
  172.     information.
  173. f. Any recommendation of the Board with respect  to the
  174.     matters  described in paragraph e above shall  be binding on
  175.     all  departments  or  agencies of  the  Government  if  it is
  176.     adopted  by the  unanimous vote of the  members of the Board.
  177.     Recommendations  approved by  the majority,  but not  all, of
  178.     the  members of the Board  shall be transmitted by  it to the
  179.     Special  Committee for  such action as  the Special Committee
  180.     may see fit to take.
  181. g. The Board will meet monthly,  or oftener at the call
  182.     of  the Chairman  or any member, and  shall determine its own
  183.     procedures.
  184.  
  185.     2. A directive to  the Secretary of Defense.   This
  186.     directive shall include the following provisions:
  187.  
  188. a. Subject   to  the  specific   provisions  of   this
  189.     directive, the Secretary of  Defense may delegate in whole of
  190.     in  part  authority  over the  Director  of  NSA  within  his
  191.     department as he sees fit.
  192.  
  193. b. The COMINT  mission of the National  Security Agency
  194.     (NSA) shall be to provide an effective,  unified organization
  195.     and control of the communications  intelligence activities of
  196.     the United States  conducted against foreign  governments, to
  197.     provide for  integrated operational  policies and  procedures
  198.     pertaining thereto.   As  used in  this directive,  the terms
  199.     "communications intelligence"  or "COMINT" shall be construed
  200.     to mean all  procedures and methods used in  the interception
  201.     of communications  other  than foreign  press and  propaganda
  202.     broadcasts  and  the  obtaining  of   information  from  such
  203.     communications by other  than intended recipients,  but shall
  204.     exclude censorship  and the  production and dissemination  of
  205.     finished intelligence.
  206.  
  207. c. NSA shall be administered  by a Director, designated
  208.     by  the  Secretary of  Defense  after  consultation with  the
  209.     Joint Chiefs of Staff, who shall serve for a  minimum term of
  210.     4  years and  who shall be  eligible for  reappointment.  The
  211.     Director shall be a career commissioned officer of  the armed
  212.     services  on active or reactivated status, and shall enjoy at
  213.     least 3-star rank during the period of his incumbency.
  214.  
  215. d. Under the  Secretary of  Defense, and in  accordance
  216.     with approved  policies of USCIB,  the Director of NSA  shall
  217.     be responsible  for accomplishing  the mission  of NSA.   For
  218.     this purpose all  COMINT collection and production  resources
  219.     of  the United States  are placed  under his  operational and
  220.     technical  control.    When  action  by  the  Chiefs  of  the
  221.     operating  agencies of the  Services or  civilian departments
  222.     or  agencies is  required, the Director  shall normally issue
  223.     instruction  pertaining to  COMINT operations  through  them.
  224.     However,  due  to the  unique technical  character  of COMINT
  225.     operations,  the Director  is authorized  to issue  direct to
  226.     any  operating elements  under  his operational  control task
  227.     assignments and pertinent  instructions which are within  the
  228.     capacity of such elements to accomplish.  He  shall also have
  229.     direct   access  to,  and   direct  communication  with,  any
  230.     elements  of the  Service or civilian  COMINT agencies on any
  231.     other  matters of operational and technical control as may be
  232.     necessary,  and he  is authorized to  obtain such information
  233.     and intelligence material from  them as he may require.   All
  234.     instruction  issued  by  the  Director  under  the  authority
  235.     provided in this paragraph  shall be mandatory, subject  only
  236.     to  appeal  to  the Secretary  of  Defense  by the  Chief  of
  237.     Service or head of civilian department of agency concerned.
  238. e. Specific  responsibilities  of the  Director of  NSA
  239.     include the following:
  240.      (1)  Formulating  necessary operational  plans and
  241.      policies for the conduct of the U.S. COMINT activities.
  242.      (2)   Conducting   COMINT   activities,  including
  243.      research and development, as required to meet the needs
  244.      of the  departments and agencies  which  are authorized
  245.      to receive the products of COMINT.
  246.      (3)  Determining,  and  submitting to  appropriate
  247.      authorities, requirements for  logistic support for the
  248.      conduct of  COMINT activities,  together with  specific
  249.      recommendations  as  to  what each  of  the responsible
  250.      departments  and  agencies  of  the  Government  should
  251.      supply.
  252.      (4) Within  NSA's field  of authorized  operations
  253.      prescribing  requisite  security  regulations  covering
  254.      operating   practices,   including   the  transmission,
  255.      handling and distribution of COMINT material within and
  256.      among  the COMINT  elements  under  his  operations  or
  257.      technical   control;   and  exercising   the  necessary
  258.      monitoring   and    supervisory   control,    including
  259.      inspections if necessary, to ensure compliance with the
  260.      regulations.
  261.      (5)  Subject   to  the  authorities   granted  the
  262.      Director  Central  Intelligence   under  NSCID  No.  5,
  263.      conducting all liaison on  COMINT matters with  foreign
  264.      governmental communications intelligence agencies.
  265. f. To  the extent he  deems feasible and  in consonance
  266.     with  the aims  of maximum over-all  efficiency, economy, and
  267.     effectiveness, the Director  shall centralize  or consolidate
  268.     the  performance  of  COMINT   functions  for  which  he   is
  269.     responsible.  It is recognized that in  certain circumstances
  270.     elements of the Armed Forces and other  agencies being served
  271.     will require close COMINT support.  Where necessary for  this
  272.     close  support,  direct  operational  control  of   specified
  273.     COMINT  facilities  and resources  will be  delegated  by the
  274.     Director,  during such  periods  and for  such tasks  as  are
  275.     determined  by him,  to military commanders  or to the Chiefs
  276.     of other agencies supported.
  277. g. The  Director  shall exercise  such  administrative
  278.     control  over COMINT activities as he  deems necessary to the
  279.     effective   performance   of   his   mission.      Otherwise,
  280.     administrative  control  of  personnel  and  facilities  will
  281.     remain with the departments and agencies providing them.
  282. h. The Director shall make provision for participation
  283.     by  representatives of  each of the  departments and agencies
  284.     eligible to receive COMINT  products in those offices of  NSA
  285.     where  priorities  of  intercept and  processing  are finally
  286.     planned.
  287. i. The  Director shall  have  a civilian  deputy whose
  288.     primary responsibility  shall be  to ensure the  mobilization
  289.     and  effective  employment of  the best  available  human and
  290.     scientific  resources in the  field of cryptographic research
  291.     and development.
  292. j. Nothing  in  this  directive  shall contravene  the
  293.     responsibilities  of the  individual departments and agencies
  294.     for  the  final   evaluation  of   COMINT  information,   its
  295.     synthesis  with  information  from  other  sources,  and  the
  296.     dissemination of finished intelligence to users.
  297.  
  298.     3. The  special nature of  COMINT actives requires that  they
  299.     be treated  in all  respects as  being outside  the framework  of
  300.     other  or general  intelligence  activities.   Order, directives,
  301.     policies, or recommendations  of any  authority of the  Executive
  302.     Branch   relating  to   the  collection,   production,  security,
  303.     handling, dissemination, or  utilization of intelligence,  and/or
  304.     classified material, shall  not be applicable to  COMINT actives,
  305.     unless  specifically   so   stated  and   issued   by   competent
  306.     departmental of agency authority represented on the Board.  Other
  307.     National Security Council Intelligence Directive to the  Director
  308.     of  Central  Intelligence  and  related  implementing  directives
  309.     issued by the Director of Central Intelligence shall be construed
  310.     as  non-applicable  to  COMINT  activities, unless  the  National
  311.     Security Council has made  its directive specifically  applicable
  312.     to COMINT.
